Hattiesburg boss threatened ICE after my husband got hurt is that a trap?

If he backs off because of that threat, he can lose medical treatment, wage benefits, and valuable proof before the deadline clock runs out.

The common wrong answer is: "If you're undocumented, you can't file anything in Mississippi." That is not how this works.

For a job injury, Mississippi workers' comp is based on whether he was an employee injured at work, not whether the employer likes his paperwork. The claim system runs through the Mississippi Workers' Compensation Commission, and employers do not get to cancel those rights by hinting at ICE.

The timing matters. In Mississippi, a work injury should be reported to the employer within 30 days. A formal workers' comp claim is generally due within 2 years of the injury, or 2 years from the last payment of compensation in some cases. End-of-year pressure is a favorite tactic: rush a tiny payment now, then argue later that the case is closed.

A deportation threat is a red flag because it often means the employer knows the injury should be covered. Keep:

  • ER, clinic, and urgent care records from Hattiesburg
  • texts, voicemails, and supervisor messages
  • pay stubs, schedules, and coworker names
  • photos of the scene and injury

If the threat came after he reported unsafe conditions or an injury, that can also trigger a retaliation issue. OSHA takes retaliation complaints, and the deadline can be as short as 30 days. If wages were stolen or he was misclassified, the U.S. Department of Labor may also matter.

If this was not a work injury - for example a stair collapse, bad medical treatment, or a crash on US-49 or I-59 - immigration status usually does not erase the right to bring a Mississippi injury claim either. The usual personal injury deadline is often 3 years in Mississippi, but evidence disappears much faster than that.
